Kerala High Court rejects lessee’s civil suit after DRT loss in SARFAESI dispute

The Kerala High Court held that a lessee claiming under a lease created after a mortgage could not relitigate the same grievance in a civil suit after losing before the DRT. The ruling affects secured creditors and occupants because post-mortgage leases must be tested against the mortgage, Section 65A principles and the SARFAESI forum path.
