RBI requires banks, co-operative banks and NBFCs to display borrower and guarantor names, outstanding amount, asset classification and the title holder for every secured asset possessed under SARFAESI, updated monthly.
What this changes for a title check
RBI requires every bank, cooperative bank, NBFC and asset reconstruction company to publish, and update monthly, a list of secured assets they have taken possession of under SARFAESI. The list must name the borrower, the guarantor if any, their registered addresses, the outstanding amount, the asset classification, and critically, the name of the title holder of the security possessed.
This is a genuinely checkable public record. Before certifying title on a property, it is worth checking whether it or its owner shows up on any lender's published SARFAESI possession list, the disclosure will literally name the title holder the bank has on file, which is a free cross-check against what the seller is claiming. A property sitting on one of these lists is under active enforcement even if no auction sale has been registered yet, something a standard EC search will not surface on its own.
