Rajasthan High Court says District Magistrate must process Section 14 SARFAESI application despite civil suit order

The Rajasthan High Court held that the District Magistrate's role under Section 14 of the SARFAESI Act is administrative and limited to checking the statutory affidavit. A collateral civil suit or interim order does not let the Magistrate adjudicate title or stall assistance to the secured creditor, which affects possession-risk checks for mortgaged property.
