Do I Need a Lawyer to Buy Property in India? What to Do Yourself

No law makes you hire a lawyer to buy property in India, but title risk is real. You can screen records yourself; an advocate should confirm title before you pay.

Problem & Risk

In India, no law requires you to hire a lawyer to buy property. The Registration Act lets the person who signs the deed, or their authorised agent, present it for registration. But a purchase is large and hard to undo, so an advocate should confirm the title before you pay. You can do the first screening yourself on public portals.

Last updated: 6 November 2026

In short

  • Not mandatory, but advised. The registration office does not ask for an advocate. Your risk does not go away because of that.
  • You can screen yourself. Land record, encumbrance, court search, RERA and CERSAI are public.
  • An advocate judges what the portals cannot show. That includes the chain of title, unregistered claims, heirs and the wording of your agreement.
  • Cost varies. It depends on the property, the number of past deeds and the scope. We found no official fee schedule.
  • An AI report is a first screen. It does not replace an advocate's signed opinion.

What you can verify yourself and what needs an advocate

TaskDo it yourself?Why
Find the owner on the land recordYesPublic portal, for example Bhoomi in Karnataka or MAHA Bhulekh in Maharashtra
Pull the encumbrance recordYesState registration portals such as TNREGINET in Tamil Nadu
Search court cases by nameYes, with limitseCourts misses spelling variants and some forums
Check a bank chargeYesCERSAI public search
Check RERA registration and complaintsYesState sites: K-RERA, MahaRERA

Decide whether an unregistered agreement, family partition or will affects titleNeeds an advocateA legal question, not a record lookup
Confirm heirs and co-ownersNeeds an advocateSuccession law differs by religion and by facts

Why people skip a lawyer, and where it goes wrong

Buyers skip a lawyer to save money or time, or because the builder or broker says the papers are fine. Three common failures:

  1. A clean portal, a bad title. An encumbrance record lists registered deeds only. A deal with no registration will not appear on it.
  2. A seller who is not the full owner. A co-heir or a minor may hold a share that the seller ignored.
  3. A weak agreement. The agreement to sell is where you set refund terms, conditions and timelines. A form copied from the internet may not protect you.

An advocate does not make the risk zero. A signed opinion does give you a person who has read the papers and who answers for the advice.

How much does property verification cost in India?

Fees vary, and no official schedule sets them. Advocates and firms quote on scope. We did not find a government-published or bar-published rate, so this page does not give a rupee range.

What moves the quote:

  • Length of the title chain. A 30-year search with many transfers takes more work than a one-owner flat.
  • Property type. Agricultural land, inherited land and plots in unapproved layouts take more checks than a new flat in a RERA project.
  • Number of documents and states involved. Records in another city or state add travel and local searches.
  • Scope. A quick document review, a title search report and a full legal opinion are different products.
  • Extras. Public notice in newspapers, drafting the sale agreement and the sale deed, and registration help are priced separately.
  • Who asks. Many banks use their own empanelled advocates for loans. SBI, for example, collects a legal opinion and search report fee for its empanelled advocate at actual cost (SBI home loan terms). Ask your lender what it needs before you hire a second advocate.

Get a written quote that names the deliverable (for example a 30-year title search report), the documents covered and the time. Government stamp duty and registration fees are separate and are not legal fees. The guide to property legal opinion cost in India goes into the cost drivers further.

How an AI report fits

An AI property report reads your documents and flags gaps, name mismatches, missing links in the chain and risk signals. It helps you in three ways:

  • Speed. You see issues in minutes, before you spend time on a call or a site visit.
  • Better questions. You go to the advocate with a list, which narrows the work.
  • A second look. A model can catch a missing page or a date mismatch that a tired reader skips.

It has limits. It reads what you upload. It does not visit the site, speak to neighbours or sign an opinion. It can be wrong. Treat it as a first screen, and have an advocate confirm anything that matters.

LegiScore is one such tool: an AI property title and risk report with an AAA to C rating, for buyers, lawyers and banks. Buyers can see LegiScore for property buyers, starting at Rs 999 for buyers.

A practical order of work

  1. Run the online checks in how to check a property online in India.
  2. Collect the document set from what to check before buying property in India.
  3. Get an AI screen or a quick review to find the gaps.
  4. Hand the papers and the gap list to an advocate. Ask for a written opinion.
  5. Sign the sale agreement only after the advocate clears the title, and pay in stages tied to checks.
  6. Register the sale deed and complete the mutation or khata transfer in your name.

When you should never skip an advocate

  • Resale with a long chain, inherited property or several co-owners.
  • Agricultural land, converted land or a plot in a layout without clear approval.
  • Seller who acts on a power of attorney.
  • Any loan-funded purchase where the lender needs an opinion.
  • Anything where a court case, mortgage or tenant shows up in your search.
  • NRI purchases and company sellers.

This page is general information, not legal advice. A local advocate should confirm the position for your property.

Frequently Asked Questions

Do I need a lawyer to buy property in India?

No law requires one. The person who signs the deed, or their authorised agent, can present it for registration. You should still hire one to confirm title, because mistakes are costly and hard to reverse.

Can I verify a property myself without a lawyer?

You can screen it yourself using land records, the encumbrance record, eCourts, RERA and CERSAI. A lawyer is needed to read the chain of title, judge unregistered claims and review the agreement.

How much does property verification cost in India?

It varies by the length of the title chain, the property type, the scope of work and the city. Ask for a written quote naming the deliverable. Stamp duty and registration fees are separate.

Is an AI property report enough to buy a property?

No. It is a first screen that finds gaps in the documents you upload. An advocate should confirm title before you pay.

Does my bank's legal check replace my own advocate?

Not fully. The bank's advocate protects the lender's interest. You may still want your own advice on title and on the agreement.
