Banks and NBFCs in India typically check a property in four ways before a home loan is disbursed: a legal opinion or title search report (TSR) from a panel advocate, a valuation, a technical inspection, and a CERSAI search for existing charges. The loan moves only when title is clear and the property value supports the amount.

In short
- The property is the lender's security, so the lender verifies it separately from your income and credit checks.
- A panel advocate reviews title documents and gives a legal opinion or TSR.
- A valuer or engineer inspects the property and sets its assessed value, which caps the loan.
- A CERSAI search shows whether a security interest is already registered on the property.
- Gaps in title, claims, litigation or approvals should be cured before disbursement.
The four tracks at a glance
| Track | Who does it | What it answers |
|---|---|---|
| Legal verification | Lender's empanelled advocate | Does the seller own it, is title clear, are approvals valid? |
| Valuation and technical check | Approved valuer or engineer | What is it worth, and does the building match the plans? |
| CERSAI and encumbrance search | Lender's operations or legal team | Is there an existing charge or mortgage on it? |
| Credit appraisal | Lender's credit team | Can the borrower repay? (Separate from property checks.) |
1. Panel advocate: legal opinion or TSR
Lenders usually keep a panel of advocates. The advocate reviews the title documents and issues a legal opinion or TSR. One lending platform's explainer describes the review as covering title documents and prior ownership, encumbrance records, mutation or revenue records, building approvals, occupancy or completion certificates, and society documents for flats (Finnable).
A typical TSR covers:
- A property schedule and the search period.
- Documents examined.
- A deed-by-deed chain of title.
- Encumbrance certificate findings.
- Mutation records.
- A court litigation search.
- A defects list, a stated opinion and a disclaimer.
Our 30-year TSR format guide shows each section. The search period is set by the lender's policy; 30 years is common. Check which period your bank uses.
2. Valuation and technical check
A valuer or engineer visits the property. The same explainer says the visit confirms dimensions, compares the structure with the available plans and sets the assessed value, which sets the maximum loan. If the assessed value is below the price you agreed, you may need a larger down payment, or the seller may need to reduce the price (Finnable).
For housing finance companies, RBI's directions require an approved valuation policy for realistic valuation of properties, covering empanelment of valuers (RBI Housing Finance Companies Directions, 2025).
3. CERSAI search
CERSAI is the central registry where lenders record security interests. An RBI circular of 27 December 2018 (RBI/2018-19/96) told scheduled commercial banks, small finance banks, local area banks, co-operative banks, NBFCs and all-India financial institutions to file certain security interests on CERSAI. These include mortgages of immovable property other than by deposit of title deeds, and security interests in under-construction property created by an agreement other than a mortgage (RBI circular).
The CERSAI site lists asset-based, borrower-based and AOR-based searches in its public search menu (CERSAI). Lenders use this kind of search to see if the property is already charged to another lender. Ask your lender which search it runs, since lender practice varies.
4. Documents lenders ask for
The exact list differs by lender, state and property type. Expect these:
| Document | Why the lender wants it |
|---|---|
| Sale deed or title deed (registered) | Proves the seller's ownership |
| Earlier deeds in the chain | Shows how ownership passed to the seller |
| Encumbrance certificate | Shows registered transactions and charges |
| Property tax receipts, khata or mutation entry | Shows the owner on local and revenue records |
| Approved building plan, commencement and occupancy or completion certificate | Shows the building is legal |
| Society no-objection or share certificate (flats) | Confirms society rights |
| Agreement to sell or allotment letter | Needed for a new purchase |
| Builder or project approvals, RERA registration (under-construction) | Confirms project status |
| Seller ID and, if relevant, a power of attorney or will | Confirms who signs and with what authority |
Typical stages of the process
- You apply and the lender does credit appraisal.
- You submit property documents.
- The panel advocate reviews them and may raise queries.
- The valuer and technical team inspect the property.
- The lender runs its encumbrance and CERSAI checks.
- The lender reads the legal opinion and valuation together and issues the sanction terms.
- You complete any cure steps, such as missing papers.
- The mortgage is created and, where required, registered or recorded, then the loan is disbursed.
The stage names differ by lender. Total time depends mostly on how complete your documents are at step 2.
How to avoid delays
- Collect the full chain of deeds before you apply.
- Ask the seller for the latest encumbrance certificate and tax receipts.
- Answer advocate queries the same day.
- Confirm that approvals match the actual building.

Frequently Asked Questions
Why does a bank need a legal opinion for a home loan?
The property is the bank's security. The opinion tells the bank whether the seller has clear title and whether claims or approval gaps could weaken that security.
What is the difference between legal verification and technical verification?
Legal verification checks title, claims, records and approvals. Technical verification checks the physical property and its value.
What is a CERSAI search?
It is a search of the central registry where lenders record security interests, used to see if a charge is already registered on a property.
Can I choose my own advocate for the bank?
Usually the bank uses its own panel advocates. Ask your lender whether it accepts an opinion from outside its panel.
What if the legal opinion finds a defect?
The lender may ask you to cure it, for example by getting a missing deed or a corrected record, before the loan is disbursed.
